If your business includes music, dancing or other entertainment as part of your operation, and your business does not fit into the Entertainment Ordinance’s exemptions, you are required to have a Business Entertainment Permit. Entertainment includes live and amplified music, DJs, public dances, open mic nights, and other entertainment activities meant to attract the public.
Business Entertainment Permits are not required for businesses which have only ambient music, businesses with an occupancy limit of less than 75 persons, businesses which only host private events such as wedding receptions or worship services, performances by students at schools, movie theaters which are not providing live entertainment, dance or theatrical lessons, book or poetry readings, billiard and pool parlors which don’t include other entertainment, amusement arcades and miniature golf courses which do not include other entertainment, athletic clubs or fitness centers, sporting events, or adult entertainment establishments.
Entertainment staff ask for a minimum of 45 days to process your Business Entertainment Permit application. This process can be lengthy, with several City Departments required to view the application and provide comments. All new applications must also go before the Entertainment Commission, which meets twice monthly, in order to receive final approval.
Business Entertainment Permits are not transferable. If a business changes ownership, or if a business changes locations, a new Business Entertainment Permit application must be submitted, and the old Business Entertainment Permit is rendered invalid.

Adults over 21 years of age, and those over 18 years of age with a valid medical marijuana prescription may grow up to six plants, indoors, at a single residence. The Modesto City Code is
To review or receive a copy of a public record, you must first make a request to the City Clerk's Office or the City department that has the records you are interested in reviewing. For example, if you are interested in reviewing a copy of a report from the Department of Public Works, you should direct your request to that Department.
Every record made or received by the City is presumed to be a public record, unless it is subject to an exemption. Exempt records are those that Federal, State or Local law prohibits the City from disclosing or permits the City to decline to disclose. For example, the United States and California Constitutions prohibit the disclosure of personal information that would violate an individual's right to privacy.
The custodian of records must either give you a copy of the requested record or provide you with a written justification of why the record is not public (i.e. exempt from disclosure). The City is not required to create a document in response to a request. Nor is the City required to honor prospective requests.

It is the policy of the City Modesto to process refunds for overpayment within four weeks. Overpayments must be researched and analyzed prior to any refund being issued. In the event of a balance on a previously unpaid invoice, any refund due will be applied towards this balance. Refund requests will be sent to the Accounts Payable division for processing and will be issued in the form of a check.

The following policy has been created pursuant to the Modesto Municipal Code 9-1.708 Fee Refunds. This policy is not intended to cover all scenarios that may relate to permit fee refunds. All refunds must be approved by the Chief Building Official.

Permits are not required for one-story detached storage sheds 120 square feet or less in area.

Zoning is the law that regulates how property is used and sets standards for new construction. Some properties are zoned to allow only homes and other properties are zoned to allow stores and businesses. The purpose of establishing zoning designations is to ensure that neighboring land uses are compatible with one another. Residential uses are generally not compatible with industrial uses.

A legal-nonconforming condition is a building or use of property that was lawfully built and maintained, and that because of changes to zoning or development standards, no longer conforms to the regulations of the zone in which it is located. A legal-nonconforming use or building may remain at its location and if destroyed by accidental or natural causes, be rebuilt up to the original size for up to one year following destruction. The Zoning Code allows for limited expansion of non-conforming uses. This information can be found online.
A variance is an exception to requirements of the Zoning Code for development of property, such as building setbacks. A variance may be justified when a regulation restricts the use of property because of some unique feature of the property such as its shape or topography. A variance requires approval by the Board of Zoning Adjustment at a public hearing.

The location of your property line can be verified by a Licensed Land Surveyor (LLS). You can find a Licensed Land Surveyor by looking online or in the Yellow pages under “Surveyors – Land” or “Engineers – Civil”. Changing the boundary between two properties requires what is called a Lot Line Adjustment, which must be approved by the City. Sheds or gazebos are buildings that can be used to support the primary residential structure, which are also known as Accessory Structures (PDF).
A structure such as a patio cover or sunroom that is connected to your house is considered part of the house and is not an accessory structure. These types of structures require a building permit, must meet setbacks and can’t exceed the lot coverage requirements. Accessory dwelling units, otherwise known as second units, granny-units, guesthouses, mother-in-law quarters, are allowed by the City on most residential lots. The development of an accessory dwelling unit must meet standards such as size, height, setbacks, lot coverage, and parking. All single-family residential units must provide two off-street parking spaces. In order to convert garage space into a bedroom, office, game room, or other living space, the property owner must demonstrate the ability to meet the off-street parking requirements. When a customer updates their Business address, they will need to fill out a Notice of Information Change Form (PDF). If the business has moved to a residential address, a Home Business Permit and Agreement (PDF) is also required.
If the business will still be inside the city limits, there is a five dollar ($5) fee for changing the Business address. There is no fee for the Business address change if moving outside the city limits.

Record the primary Standard Industrial Classification (SIC) code(s) for your business type for verification purposes on the Stormwater Discharge Compliance form provided by the City of Modesto. When renewing or applying for a Business license in the City of Modesto.
Only those businesses with primary Standard Industrial Classification (SIC) codes that are identified by the State Water Board as requiring enrollment in the Industrial General Permit (IGP) are affected. Metered: If your location is charged a metered water or sewer rate the service period appearing on your bill is from reading date to reading date. Any flat rate service charge also appearing on the bill will differ from these dates.

On August 9, 2016 City Council reviewed and adopted a Water Rate and Fee Study that included an annual review of the water rate increase. On October 22, 2019 City Council reviewed and adopted the scheduled water rate increase of 6%, effective April 1, 2020.
On April 1, 2020, the water rate will increase by 6%. Since the new rates takes effect April 1st, your bill will have prorated charges on it. The old rate will be used for water charges prior to April 1st, and the new rate will be used for water charges after April 1st.

Yes. A renewal letter along with an Application Form (PDF) will be sent to you every other year when it is time to renew. You have thirty (30) days to reapply to avoid any lapse in receiving the discount.
A deposit may be required to establish service with the City of Modesto. Based on guidelines provided by the State of California, a deposit is not to exceed three times the average monthly bill for the property address. A deposit will also be added to active utility accounts if service is disconnected for non-payment. The deposit shall be applied to the closing bill upon the discontinuation of services and any remaining credit will be refunded. Payments received after 3 p.m. on accounts that are disconnected, will not have the service restored until the following business day. Only City personnel are authorized to disconnect and/or reconnect service. Unauthorized tampering/damage could delay restoration of services up to one week and result in additional fees.

Delinquent notices will be mailed on past due accounts allowing 14 days for payment to be received to avoid disconnection. Checks are not accepted for accounts once a final notice has been mailed. The entire balance as stated on the final notice is required to avoid disconnection.

If you believe that the city is responsible for damages to you or your property, you must file a written claim within 6 months of the incident in most cases. In order to meet legal requirements you must supply specific information. To assist you in meeting those requirements, the city has prepared a claim form for your use. Completed claims should be mailed or hand delivered to the City Clerk's Office along with copies of invoices, receipts or pictures documenting your damages.

One half of your rental fee, as well and security deposit, is due at the time of reservation. All other outstanding reservation fees will be due in full within ninety (90) days prior to first rental date on contract. Any reservation made within ninety (90) days of the rental date must be paid in full at the time of reservation.
Payment must be by cash, Visa or MasterCard, money order or cashiers check only. No personal or company checks are allowed for facility rental payments.
Cash or credit card payments are the only form of payment accepted within three days of your reservation date.

The key for American Legion Hall and Boy Scout Clubhouse uses may be picked up the business day prior to the rental. The key is due back by 4:30 pm the first business day following the rental.
Insurance, security and other permits may be required at some facilities for some events. The Modesto Police Department determines security and permit requirements. Insurance and Security may be provided through a private company or purchased through the City.

The center offers a variety of non-fee sports and fitness activities for all ages, tutorial and learning opportunities and a variety of special events including, dance classes, Police Activities League (PAL) Boxing Program and Stanislaus County Office of Education Work-4-Success Program.
Registrations for all teams are taken at 1010 Tenth Street, 4th Floor, in the Parks, Recreation and Neighborhoods Department. In addition to league fees, you must also turn in your team roster with player signatures. For more information, contact Tony Amaral at 209-577-5445.

If your car was towed/stored for 30 days due to driving on a suspended license:
-Come to the main lobby and fill out a Request for 30-Day Hearing form. You are entitled to a hearing within 48 working hours. The hearing officer will review your case and, under certain guidelines, may release the vehicle early. If the storage is sustained, you will be required to wait the full thirty days to obtain a release. For further information, you may call the traffic unit at 209-572-9592 during regular business.
If your car is eligible for release, come to the main lobby during regular business hours with the registered owner, a licensed driver, and current vehicle registration. A vehicle release fee will be charged.

The goal of the Wakeup program is to teach young people to make correct choices and understand that the decisions they make today will affect their future.
Classes are facilitated by a police officer with assistance from law enforcement personnel, family service agencies and community organizations.
Classes are held at the Modesto Police Department once a week for nine weeks. During each class session instructors share their specialized knowledge and experience to provide a straightforward, realistic view about the realities associated with making poor choices.
In addition, there is an all-day field trip for all participants to Deuel Vocational Institution (DVI) where they are given a tour of the prison and participate in the Straight Life Program.
This program is designed for youth ages 11 through 17 years old and their parents.
It is mandatory for at least one parent to be in attendance at each class session along with their child.

Mistletoe is a problem for Modesto’s trees, and if it is not promptly removed, it spreads from tree to tree, weakens the tree, and can kill trees that are stressed from other factors. To report a concern, submit an online request.
Trees are a living public asset and provide unique environmental and aesthetic benefits to every neighborhood. However, at some point in a tree’s life cycle, it may die or require removal due to risk factors. Modesto makes every effort to preserve trees. When a tree is removed, it is removed entirely and replaced in most instances. Root cutting/shaving is another service the Forestry Division offers. This service is provided to reduce the risk from above ground roots or deeper roots that may potentially cause damage to public and private property.

Modesto maintains a database of its 81,000 street and park trees. This database records planting and maintenance of every City tree. The City is in the process of updating its tree inventory and Urban Forest Management Plan, and is working with state agencies on this effort. Press the intercom at the Pay Station near the elevator or call 209-342-2216 and courtesy staff will bring you a lost ticket replacement. If you lose or damage your ticket, you will be charged $15, the maximum daily fee.
Parking garages do not have attendants on staff to collect cash. Pre-paid parking is available only at the 11th Street Parking Garage after 6:00 PM at the pay station on Sunday-Thursday. Event days, as well as Fridays and Saturdays, are "pre-pay upon entry" after 5:00 PM. Pre-paying your parking fee before going to your destination helps alleviate some traffic congestion upon exit of the parking garage, since this garage has only one entrance and exit. Please note: The City cannot honor merchant validations for pre-paid parking fees.
Pre-paid parking at any parking facility may be necessary for large events that have a significant impact to parking operations, such as downtown festivals and the Amgen Tour. Pre-paid parking during special events is evaluated on a case-by-case basis and signs will be posted at parking entrances. If your event is open to the public and includes entertainment such as live or amplified music, DJs, dancing to live or recorded music, presentations by performers, carnival rides, circus act or other activities meant to be attended by members of the public, then you will need a Special Event Entertainment Permit to hold your event. Parades and sporting events do not require a Special Event permit, although parades require their own permit which can be found on Modesto Police Department forms and applications page.
Yes. Your Business Entertainment Permit is valid within your business facility, but if any part of your event will take place any area outside of your business facility, such as a patio or parking lot adjacent to your facility, you will need to apply for a Special Event Permit to cover that event.
Entertainment staff ask for a minimum of 45 days to process your Special Event Entertainment Permit application. This process can be lengthy, with several City Departments required to view the application and provide comments. All new applications must also go before the Entertainment Commission, which meets twice monthly, in order to receive final approval. Be certain to submit your paper work well in advance of your desired event date.

Many personal hygiene wipes, baby wipes, and cleaning products are marketed as being “flushable”, but despite the confusing and misleading labels you should never flush “flushable” or "disposable” products. These products do not break down as they move through the sewer system and can cause blockages in your home sewer lines, resulting in the backup of sewage into the home. They can also cause blockages in the City’s sewer pipes and pumps causing sewer overflows, costly cleanup and repairs and extensive environmental damage. Remember, the only things that should be flushed are human waste and toilet paper.

Protect the Tuolumne River by keeping grease out of sewers. These are the steps used to properly clean a grease trap.
Open cooled trap. Remove surface grease solids with slotted spoon, and oil with solid spoon. Place in a double lined plastic bag
Scrape grease from sides and dividers into the disposal bag.
If sediment is less than two (2) inches thick, call a licensed company to pump the trap clean.
Remove, inspect, and clean screen.
Pour cat litter into bag of grease and mix until solidified.
Tie bag securely and place in dumpster.
Reassemble, tighten lid, and record on log sheet.
The Sustainable Groundwater Management Act of 2014 is a comprehensive three-bill package that includes AB 1739 (Dickinson), SB 1168 (Pavley), and SB 1319 (Pavley) and sets the framework for statewide long-term sustainable groundwater management by local authorities. According to California Health and Safety Codes 116800 and 116407; Water Code 13553 and 13578; and Modesto Municipal Code Article 20 section 9-8.2003 Plumbing hazards and 11-1.14 sections (g, i, j, k, l, and m): backflow preventers are required on all commercial buildings that have a potential cross-connection.
Backflow assemblies are devices that are installed at the point of connection/service and prevent non-potable substances from flowing back into the drinking water supply. There are various types of assemblies that are specific for certain applications.
You received this letter because an approved backflow assembly is required to be installed at the service connection to protect from potential backflow conditions.
If you had the assembly tested, repaired, or installed contact your tester / installer to ensure the test report was sent to the City of Modesto cross-connection control staff. If the work has not been completed you need to do so to ensure there is no interruption in your water services.

Nitrate contamination of potable water sources is becoming one of the most important water quality concerns. The maximum contaminant level (MCL) for nitrate is 10 milligrams per liter (Mg/L) as nitrogen (N). Once a water supply becomes contaminated with nitrate, it is costly to treat. Ion exchange and reverse osmosis treatment units are used to remove nitrate from drinking water.
